TN Visa Process and Variables

TN visas are a type of non-immigrant visa specifically designed for qualified Canadian and Mexican citizens who wish to engage in professional business activities within the United States. Established under the North American Free Trade Agreement (NAFTA), which has since been replaced by the United States-Mexico-Canada Agreement (USMCA), the TN visa aims to facilitate economic and trade relations between the three countries by allowing the free movement of professionals.

Eligibility Criteria

To be eligible for a TN Visa, applicants must fulfill several key criteria:

  • Citizenship: Must be a citizen of Canada or Mexico; permanent residents or individuals with other statuses do not qualify.
  • Profession: Must work in a profession that is listed in the USMCA/NAFTA agreement. This list includes but is not limited to accountants, engineers, lawyers, pharmacists, scientists, and teachers.
  • Position: The job in the U.S. must require a NAFTA professional.
  • Education and/or Experience: Must possess the necessary education level or credentials, and/or work experience, as required by the specific professional category under the USMCA/NAFTA list.

Application Process

The application process for a TN visa differs slightly between Canadian and Mexican citizens:

  • Canadians: Canadian citizens generally do not need a visa to enter the U.S. as TN professionals. Instead, they can apply directly at a U.S. port of entry or pre-clearance/pre-flight inspection station by presenting required documentation, such as proof of Canadian citizenship, a letter from the prospective U.S. employer detailing the professional capacity in which they will work, and evidence of qualifications.
  • Mexicans: Mexican citizens are required to obtain a TN visa at a U.S. consulate or embassy in Mexico before entering the U.S. This process involves submitting a TN visa application, providing the necessary documentation, and attending an interview.

Period of Stay

Initially, TN visa holders are granted a stay of up to three years. However, the stay can be extended in increments of up to three years with no maximum limit on the number of extensions, provided the individual continues to meet the eligibility criteria.

Dependents

Dependents of TN visa holders, including spouses and unmarried children under the age of 21, may be eligible for TD status (TN Dependent). While dependents can study in the U.S., they are not permitted to work unless they obtain their own work visa.

Considerations

It’s important to note that the TN visa is strictly for professional employment and cannot be used for intent to immigrate. Holders of a TN visa must intend to return to their home country upon the expiration or termination of their visa.

In summary, the TN visa provides a valuable opportunity for Canadian and Mexican professionals to work in the U.S. in a wide range of fields, supporting cross-border exchange and cooperation in the North American region.
